Terms of Service

This agreement (the "Agreement") is entered into by and between you ("you") and News Rush, LLC ("News Rush") regarding your use of all aspects of newsrush.com (the "Service"). By using or accessing the Service, you signify your acknowledgment and assent to the terms and conditions of use set forth below, as well as News Rush's Privacy Policy.

Rights Associated with the Service

The Service is designed to help you find news information that resides on websites not owned or controlled by News Rush. In particular, the Service provides brief descriptions of news stories to help you identify the stories of interest to you. When you select a story, you will be linked to the news site on which that story appears. News Rush owns and retains all intellectual property rights to the Service, but News Rush does not claim ownership rights to the full news stories, which are instead held by the sites to which the Service links.

News Rush does not claim ownership rights to other Content presented to you as part of the Service, including images and videos. You should be aware that this Content may be protected by intellectual property rights which may be owned by parties other than News Rush. You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by News Rush or by the owners of that Content, in a separate agreement.

By using the Service you may be exposed to Content that you may find offensive, indecent or objectionable. In this respect, you use the Service at your own risk.

User-created Content

Any Content you submit through the Service shall be deemed and shall remain the property of News Rush. You surrender all rights to Content you submit and to any profits it might generate. To the extent that you retain any rights, you hereby grant News Rush the unlimited, perpetual right to reuse, redistribute, modify and create derivative works from such Content for any purpose and in any media without compensation, and you warrant that all "moral rights" in submitted Content have been waived. By submitting Content through the Website, you release News Rush from any liability under any legal theory in connection with the use, modification, sale, or disclosure of the Content.

You agree that you are solely responsible for (and that News Rush has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Service and for the consequences of your actions (including any loss or damage which News Rush may suffer) by doing so.

Use of the Service

You may not use the Service and may not accept the Agreement if (a) you are not of legal age to form a binding contract with News Rush, or (b) you are a person barred from receiving the Service under the laws of the United States or other countries including the country in which you are resident or from which you use the Service. You may use the Service only for purposes that are permitted by (a) the Agreement and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries). You may only display the content of the Service for your own personal, non-commercial use and you may not otherwise copy, reproduce, alter, modify, create derivative works of, or publicly display any content. For example, you may not use the Service to sell a product or service; use the Service to increase traffic to your Web site for commercial reasons, such as advertising sales; take the results from the Service and reformat and display them, or use any robot, spider, other device or manual process to monitor or copy any content from the Service. You may not engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service). If you are uncertain whether your intended use of the Service is permissible, please contact us. In addition, News Rush shall have the right in its sole discretion to suspend or terminate the Service or your access to it.

Compliance with Fair Credit Reporting Act

News Rush is not a consumer-reporting agency ("Consumer Reporting Agency") as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA") and the Services and Datasets do not constitute "Consumer Reports" as that term is defined in the FCRA. You agree to not use or provide the Services or any Dataset for any purposes enumerated in the FCRA in lieu of obtaining a Consumer Report. Specifically, you agree not to use or provide the Datasets, or authorize anyone else to use or provide the Datasets, for the following purposes: in connection with establishing a consumer's eligibility for credit or insurance to be used primarily for personal, family or household purposes, or in connection with assessing risks associated with existing credit obligations of a consumer; for the purpose of evaluating a consumer for employment, promotion, reassignment or retention as an employee; for any tenancy verification or in connection with any application to rent real property; in connection with a determination of a consumer's eligibility for a license or other benefit that depends on an applicant's financial responsibility or status; as a potential investor or servicer, or current insurer, in connection with a valuation of, or assessment of credit or prepayment risks associated with, an existing credit obligation; in connection with any information, service or product sold or delivered to a "Consumer" (as that term is defined in the FCRA) that constitutes or is derived in substantial part from a Consumer Report; for any other purpose covered under the FCRA; for the preparation of a Consumer Report or in such a manner that may cause such data to be characterized as a Consumer Report. You agree not take any "Adverse Action" (as that term is defined in the FCRA), which is based in whole or in part on Services or Dataset against any Consumer.

Limitation of Liability

Under no circumstances will News Rush be liable to you or any other person for any indirect, direct, special, punitive, incidental, consequential damages of any character that arise from your or any other user's use of the Service.

Disclaimer of Warranties

News Rush makes no express warranty regarding the Service and disclaims any implied warranty, including any warranties of merchantability or fitness for a particular purpose. News Rush does not authorize anyone to make a warranty of any kind on its behalf and you should not rely on any such statement.

Indemnification

You agree to indemnify and hold harmless News Rush and its members and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever (including reasonable attorney's fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of the Service in violation of applicable law or by any person using your log on information, regardless of whether such person has been authorized to use the Service by you.

Terms of Service Changes

Although most changes are likely to be minor, News Rush shall have the right to modify the terms of this Agreement from time to time, and in News Rush’s sole discretion. News Rush encourages you to periodically check this page. Your continued use of the Service after any change in this Agreement will constitute your acceptance of such change. The terms of this Agreement may also be modified by separate agreement between you and News Rush.

Miscellaneous

If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the remaining terms of this Agreement and shall not affect the validity and enforceability of any remaining provisions. This Agreement shall be interpreted in accordance with the laws of the State of Connecticut.
